1. About these terms

These terms are an agreement between you and EP Apps ("we", "us") for your use of the Baby White Noise mobile app (the "app"). By installing or using the app you agree to them. If you do not agree, please do not use the app.

You must be an adult, or have the permission of a parent or guardian, to use the app. The app is intended to be operated by parents and caregivers, not by children.

2. What the app does

The app plays looping sounds intended to help babies, children and adults relax or sleep. It includes a sleep timer, background playback and, in Premium, Listen Mode, which starts a sound when the app detects sustained loud noise near the device.

3. Safe use

• Not a baby monitor. Listen Mode reacts to loudness. It may miss a cry, or react to other noises, and it does not alert you. Do not rely on it to know whether your child needs you.
• Not a medical device. The app does not diagnose, treat or prevent any condition, and nothing in it is medical advice. If you have concerns about your child's sleep, hearing or health, speak to a doctor.
• Supervision. The app is never a substitute for adult supervision and safe sleep practices.
• Volume and distance. Loud or prolonged sound can harm hearing, especially in babies. Keep the volume low, place the device well away from your child's head and outside the cot or crib, and do not leave a charging device within a child's reach.

4. Your licence

We give you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for your own non-commercial use, in line with these terms and the rules of the app store you downloaded it from.

You may not copy, resell or redistribute the app or its sounds, reverse engineer it except where the law allows this, remove or interfere with ads in the free version other than by purchasing Premium, or use the app in any unlawful way.

5. Premium purchase

• Premium is a one-time purchase. It is not a subscription and does not renew.
• The features included in Premium, and the price in your currency, are shown in the app before you buy. Features described as planned or coming later are not guaranteed to be delivered by any particular date.
• Payment is processed by Google Play or the Apple App Store under their terms. We do not handle your payment details.
• Refunds are handled by the store you bought from, under its refund policy and the consumer law that applies to you.
• Premium is tied to the store account used to buy it. You can restore it on another device signed in to the same account using Restore Purchase.

6. Ads

The free version of the app shows advertising provided by Google AdMob. We do not control the content of individual ads and are not responsible for the products or services they promote.

7. Privacy

Our Privacy Policy explains what information the app handles, including how the microphone is used in Listen Mode.

8. Ownership

The app, including its design, text, code and sounds, is owned by us or our licensors and is protected by intellectual property laws. These terms do not give you any rights in it other than the licence in section 4.

9. Changes and availability

We may update the app, add or remove features, or stop offering it. We try to keep the app working reliably, but we do not promise that it will always be available, free of errors, or compatible with every device.

10. Disclaimer

The app is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties, express or implied, including that the app will help any person fall asleep or stay asleep, that Listen Mode will detect any particular sound, or that playback will not be interrupted.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential losses arising from your use of the app, and our total liability to you for any claim relating to the app is limited to the amount you paid for Premium, if any.

Nothing in these terms limits any liability that cannot be limited by law, or any rights you have as a consumer under the mandatory laws of the country where you live.

12. Ending these terms

You can stop using the app and uninstall it at any time. Your licence ends automatically if you breach these terms.

13. Changes to these terms

We may update these terms from time to time. We will post the new version on this page and change the date at the top. If you keep using the app after a change, the updated terms apply to you.
